Terms and Conditions

1. Scope of Application

These General Terms and Conditions (T&C) apply to all consulting, intermediation and service activities provided by Auto Erb, Max-Valier Straße 6/8, 39012 Merano (hereinafter "we" or "Auto Erb"), towards consumers and businesses (hereinafter "customers").

2. Services

We provide in particular the following services: independent consulting for vehicle purchase/sale, search and pre-selection of suitable vehicles, accompaniment during inspections, price negotiations, support with formalities (e.g. import, registration). We typically act as intermediaries/consultants and do not become a contractual party in purchase contracts between customers and third-party providers.

3. Contract Conclusion

A contract for our services is concluded when the customer accepts our offer (in writing, by email or implicitly through utilization). The scope and content of services derive from the respective offer or service description.

4. Compensation and Payment Terms

Unless otherwise agreed, compensation is made according to the price stated in the offer (flat rate or percentage commission). Prices include applicable statutory taxes and duties unless otherwise indicated. Payments are due immediately after invoicing without deduction.

5. Liability

We are liable without limitation for intent and gross negligence. For simple negligence we are only liable for damages from violation of essential contractual obligations (cardinal obligations) and limited to typically foreseeable damage. We assume no liability for information and statements by third parties (e.g. vehicle providers) except to the extent we positively knew of their incorrectness.

6. Warranty for Vehicle Purchases

In vehicle purchase contracts, the contractual party is exclusively the respective provider/seller. Warranty or guarantee claims from the vehicle purchase exist exclusively against them. We assume no own warranty in this regard.

7. Customer Cooperation Obligations

The customer provides us with all information necessary for service delivery completely and truthfully and reports changes immediately. If the customer fails to meet their cooperation obligations, schedules may be delayed; resulting additional costs are borne by the customer.

8. Appointments, Cancellation

Agreed appointments are binding. If an appointment cannot be kept, timely notification is required. For short-notice cancellations or no-shows, we reserve the right to invoice incurred expenses unless otherwise agreed.

9. Data Protection

We process customer personal data exclusively within the framework of legal provisions. For further information please refer to our separate privacy policy.

10. Applicable Law, Jurisdiction

The law of the Italian Republic applies excluding UN sales law. For consumers this choice of law only applies insofar as the mandatory protection of the law of the state where the consumer has their habitual residence is not withdrawn. The jurisdiction for merchants is Merano, Italy.

11. Quality Assurance and Compliance

We commit to the highest quality standards in our consulting and intermediation activities. All vehicle evaluations are conducted according to standardized procedures and considering market-standard evaluation criteria. We work exclusively with reputable partners and regularly review the quality of our service providers. In vehicle intermediation we always observe applicable regulations of international trade and registration requirements. Our team receives continuous training to always provide you with current and legally secure consulting.

12. Changes to T&C

We reserve the right to change these T&C with effect for the future. The version valid at the time of commissioning is decisive.
